The Lunar Method® respects the privacy of our customers, community members, website visitors and others who interact with our business.

The Lunar Method® provides gender-swaying education, resources, products and personalized services. Certain services involve biological cycle tracking, ovulation-related observations, reproductive circumstances, personalization, lunar-energy timing and other information used within The Lunar Method® Sway® System.

Some information customers provide may be personal or sensitive in nature. Depending upon applicable law, information concerning reproductive health, menstrual cycles, ovulation, sexual activity, conception or pregnancy may receive heightened legal protection.

This Privacy Policy explains what personal information we collect, where we obtain it, how and why we use it, when it may be disclosed, how we work with service providers and third-party platforms, how we address sensitive information, how long information may be retained, how international processing may occur, and the privacy rights and choices that may be available to you.

This Privacy Policy applies to theoriginallunarmethod.com and, where applicable, Lunar Method® products, services, purchases, subscriptions, forms, analyses, calendars, communications, communities, social-media properties and other business activities.

For additional information specifically concerning sensitive reproductive information and consumer health data, please also review our Sensitive & Consumer Health Data Privacy Policy.

03 — WHAT PERSONAL INFORMATION MEANS

“Personal information” and “personal data” generally mean information relating to an identified or identifiable individual, according to applicable privacy law.

Personal information generally does not include information that has been lawfully anonymized or de-identified so that it no longer constitutes personal information under applicable law.

05 — CYCLE-TRACKING, REPRODUCTIVE & GENDER-SWAYING INFORMATION

Certain Lunar Method® products and services require information concerning a customer's biological cycle, reproductive circumstances, conception timing or gender-swaying journey because that information is relevant to providing the requested service and applying The Lunar Method® Sway® System.

Depending upon the service, this may include:

  • menstrual-cycle dates and history;

  • cycle length and cycle-to-cycle patterns;

  • luteinizing hormone (LH) test information;

  • LH test-strip photographs;

  • LH surge information and timing;

  • basal body temperature (BBT) readings or charts;

  • cervical-mucus observations;

  • cervical-position observations;

  • PdG information where applicable;

  • selected information from customer-used cycle-tracking applications or consumer devices;

  • estimated ovulation information;

  • tracking charts, screenshots and records;

  • intercourse or BD timing where relevant to the requested service;

  • conception-related information;

  • information required for Pre-Alignment or Alignment;

  • information submitted for a ZODIAC® service or analysis;

  • birth date, birth time or birth location where required for applicable lunar-energy calculations;

  • current location or time zone where required for applicable lunar-energy timing; and

  • other information reasonably necessary for the personalized service requested.

Not every customer provides every category of information.

This information may be supplied through a designated form, Gmail, Facebook Messenger or another designated submission or communication channel.

Our collection or analysis of biological cycle information does not mean that The Lunar Method® provides fertility treatment, clinical fertility monitoring, medical diagnosis or healthcare.

For additional information about our handling of these categories, please review our Sensitive & Consumer Health Data Privacy Policy.

06 — REQUIRED VS. OPTIONAL INFORMATION

Not every category described in this Privacy Policy is required for every product or service.

Where information is reasonably necessary to provide a requested personalized service, we may request the information relevant to that service. If necessary information is not provided, we may be unable to provide, personalize, continue or complete that service.

Other information may be optional.

Participation in a community, for example, does not ordinarily require a customer to publicly disclose private cycle-tracking, intercourse, conception, pregnancy or other sensitive information merely because other members choose to discuss such matters.

A customer's voluntary disclosure within a community is different from information privately requested by The Lunar Method® to perform a personalized service.

07 — INFORMATION WE DO NOT NEED YOU TO PROVIDE

Unless specifically requested because it is reasonably necessary for a service, legal matter or other legitimate purpose, please do not send us:

  • complete medical records;

  • genetic-testing records;

  • government identification documents;

  • detailed medical diagnoses;

  • prescription records;

  • unrelated health information; or

  • other highly sensitive information we have not requested.

Limited health-related information may sometimes be voluntarily provided as relevant context. Its receipt does not transform The Lunar Method® into a healthcare provider.

We may delete, restrict, return or decline to process unnecessary information where appropriate and lawful.

08 — INFORMATION COLLECTED THROUGH OUR WEBSITE

When you interact with our website, Shopify and applicable technology providers may automatically collect or process information such as:

  • IP address;

  • browser type;

  • device type;

  • operating system;

  • device or online identifiers;

  • referring pages;

  • pages viewed;

  • dates and times of visits;

  • browsing behavior;

  • website interactions;

  • product views;

  • shopping-cart activity;

  • checkout or purchase activity;

  • cookie identifiers;

  • client identifiers;

  • approximate location or geolocation information; and

  • similar technical or usage information.

Information may be collected through cookies, pixels, local storage, APIs and similar technologies.

Our website technologies may also process ordinary customer, transaction, browsing, device and marketing information according to the functionality and configuration of our ecommerce, analytics and advertising services.

Additional information and available choices may be provided through our cookie banner, Shopify privacy controls, Your Privacy Choices page and other applicable notices.

Through our website and applicable cookies, pixels, analytics and technical systems.

From Information You Choose to Share From Applications or Devices

You may send us screenshots, charts, readings, photographs or other selected information generated through cycle-tracking applications, home tests, thermometers, consumer devices or similar tools.

Unless expressly stated otherwise, sending selected information from an application or device does not give The Lunar Method® direct access to the underlying account or device.

From Other Persons

For example, an authorized representative acting on your behalf.

From Public or Legal Sources

Where reasonably necessary for fraud prevention, legal compliance, legal claims, intellectual-property protection or another lawful purpose.

10 — HOW WE USE PERSONAL INFORMATION

Depending upon the circumstances, we may use personal information to:

Provide Products & Services

Including to process purchases, administer customer access, provide digital resources, prepare applicable MOON® Calendars, provide LUNAR® Guides, administer subscriptions, fulfill physical products, provide customer support and otherwise perform our agreement with you.

11 — LAWFUL BASES FOR PROCESSING

Where applicable law requires a lawful basis for processing, we rely upon the basis appropriate to the particular processing activity.

These may include:

Performance of a Contract

Where processing is necessary to provide a requested or purchased product or service or to take requested steps before entering into a contract.

Legitimate Interests

Where processing is reasonably necessary for a legitimate interest and that interest is not overridden by applicable rights and interests.

Depending upon the circumstances, legitimate interests may include operating and securing our business, providing customer service, maintaining appropriate records, preventing fraud, enforcing agreements, protecting intellectual property, administering restricted resources, maintaining business-controlled communities and establishing, exercising or defending legal claims.

Consent

Where we request and rely upon consent.

Legal Obligation

Where processing is necessary to comply with an applicable legal obligation.

Other Lawful Bases

Where another lawful basis is available under applicable law.

Where information constitutes sensitive information, special-category personal data, consumer health data or another specially protected category, an ordinary lawful basis may not by itself be sufficient. We also address any additional condition, consent or authorization required by applicable law.

12 — SENSITIVE, HEALTH-RELATED & SPECIAL-CATEGORY INFORMATION

Some information processed through Lunar Method® services may receive heightened protection because of its nature.

Where UK GDPR or EU GDPR applies and information constitutes special-category personal data, we identify both an applicable Article 6 lawful basis and an applicable Article 9 condition or other legally required basis.

Depending upon the circumstances, an applicable condition may include explicit consent, processing necessary for the establishment, exercise or defence of legal claims, or another legally available condition.

We do not treat contractual necessity alone as automatically satisfying a separate special-category processing requirement.

Where we rely upon explicit consent, consent is requested separately and is intended to identify the relevant information and processing purpose.

Where applicable law permits withdrawal, consent may be withdrawn. Withdrawal does not affect processing lawfully undertaken before withdrawal.

Where sensitive information is genuinely necessary to provide a requested personalized service, declining or withdrawing the applicable consent or authorization may mean we cannot provide, continue or complete that service.

Declining consent does not by itself prevent access to products or services that do not genuinely require the relevant processing.

Our Sensitive & Consumer Health Data Privacy Policy provides additional information concerning these categories.

13 — IMPORTANT ACCESS & INTAKE FORM

First-time customers may be required to complete The Lunar Method® Important Access & Intake Form before initial activation or fulfillment of applicable Lunar Method® groups, programs, packages, services or associated customer resources.

The form is currently provided through Google-hosted services.

It may be used to:

  • establish applicable customer information;

  • support access and service administration;

  • document applicable acknowledgments and agreements;

  • obtain required consent choices;

  • administer fulfillment;

  • maintain appropriate customer records; and

  • meet applicable legal or operational requirements.

The Important Access & Intake Form contains a separate choice concerning consent to processing applicable sensitive cycle and reproductive information.

The customer is required to answer that choice, but consent itself is optional.

Completion of the remainder of the form, purchase of a product or service, or acceptance of contractual terms does not substitute for a customer's declined consent where consent is the basis relied upon for processing.

Declining consent may mean we cannot provide a personalized service where the relevant processing is genuinely necessary for that service.

Not every category of sensitive information described in this Privacy Policy is collected through the Important Access & Intake Form. Depending upon the service, relevant information may subsequently be supplied through Gmail, Facebook Messenger, another Google-hosted resource or another designated service channel.

14 — DESIGNATED CUSTOMER COMMUNICATION & SUBMISSION CHANNELS

Certain Lunar Method® services use Gmail and/or Facebook Messenger as designated channels through which customers may communicate with a LUNAR® Expert and submit information relevant to their service.

Depending upon the service, customers may submit cycle tracking, LH information, test-strip photographs, BBT charts, screenshots, surge information, check-in information, relevant intercourse or conception timing, questions and other reasonably necessary information.

Information transmitted through Gmail is processed through Google's systems as well as by The Lunar Method®.

Information transmitted through Facebook Messenger is processed through Meta's systems as well as by The Lunar Method®.

Use of these channels does not mean Google or Meta provides, endorses or participates in The Lunar Method® Sway® System.

Customers should use designated service channels and avoid sending unrelated sensitive information that The Lunar Method® has not requested.

15 — MARKETING

Where permitted by law, we may use appropriate contact, purchase, website and engagement information to communicate about Lunar Method® products, services, educational content, resources or promotions.

Where consent is required, we obtain applicable consent.

You may unsubscribe from promotional email through the unsubscribe mechanism provided in the communication.

Opting out of promotional communications does not prevent necessary transactional, subscription, service, security or legal communications.

We do not intentionally use private cycle tracking, LH or BBT information, intercourse or conception timing, pregnancy information, private test-strip photographs, Personalized Peak Parameters or individualized Sway® analyses to create advertising audiences or personalize advertising merely because we possess that information.

We do not sell customer lists containing private reproductive or individualized Sway® information.

16 — COOKIES, PIXELS, ANALYTICS, ADVERTISING & PRIVACY CHOICES

Our website uses or may use cookies, pixels and similar technologies for functionality, security, analytics, measurement, personalization, advertising and related purposes.

Our current ecommerce and marketing environment may include Shopify and integrations with services such as Google, Meta/Facebook/Instagram, email-marketing providers and other platforms.

Depending upon the technology and its configuration, these services may process ordinary:

  • website and browsing information;

  • device and technical information;

  • customer or account information;

  • product-view information;

  • cart and checkout activity;

  • transaction or purchase information; and

  • marketing and attribution information.

Under some privacy laws, certain disclosures or uses for advertising may constitute a “sale,” “sharing,” “targeted advertising” or similar regulated activity even when information is not literally sold for money.

Where applicable law provides a consent or opt-out right, we provide or honor the applicable mechanism.

Your Privacy Choices

Eligible visitors may use our Your Privacy Choices page to exercise applicable choices concerning activities that may be considered sale, sharing or targeted advertising under certain U.S. privacy laws:

https://theoriginallunarmethod.com/pages/data-sharing-opt-out

The availability and operation of particular choices depend upon location, applicable law and the privacy technologies applicable to our store.

Where required by applicable law and supported through our systems, we recognize legally valid browser-based opt-out preference signals, including Global Privacy Control (GPC).

Using an applicable privacy opt-out does not prevent processing that remains necessary to provide requested products or services, process transactions, maintain website functionality or security, comply with law, or undertake processing that is not subject to the applicable opt-out.

Sensitive Personalized-Service Information

The Lunar Method® does not intentionally configure advertising technologies to collect private customer:

  • cycle-tracking information;

  • LH or BBT information submitted for personalized services;

  • intercourse or conception timing;

  • pregnancy information;

  • private test-strip photographs;

  • Personalized Peak Parameters;

  • individualized Sway® analyses; or

  • comparable private reproductive-service information

submitted through designated personalized-service channels for third-party targeted advertising.

Sensitive personalized-service information is generally submitted through designated forms, communications or service channels rather than through advertising technologies.

Our website privacy practices should be read together with our cookie banner, Shopify privacy controls, Your Privacy Choices page and any other applicable notice displayed on our website.

17 — HOW WE DISCLOSE PERSONAL INFORMATION

We may disclose personal information where reasonably necessary for purposes described in this Privacy Policy.

Service Providers & Technology Platforms

We use or may use providers supporting:

  • ecommerce;

  • payment processing;

  • subscriptions;

  • hosting and technology infrastructure;

  • email;

  • forms and documents;

  • communications;

  • shipping and fulfillment;

  • analytics;

  • advertising and marketing;

  • security;

  • customer support;

  • professional services; and

  • other business operations.

The information available to a provider depends upon the service, integration and configuration involved.

A third party may act as our service provider or processor for certain activities and independently determine purposes of processing for others. Its legal role depends upon the actual processing activity and applicable law.

At Your Direction

We may disclose information where you direct, request or authorize us to do so.

Legal, Corporate & Rights-Protection Purposes

We may disclose information where reasonably necessary to comply with law or valid legal process; investigate fraud or unlawful activity; protect security; enforce agreements; establish, exercise or defend legal claims; protect intellectual-property rights; or protect our rights or those of others.

This may include limited disclosure in connection with the UK intellectual-property holding company where reasonably necessary for an applicable intellectual-property, corporate or legal matter.

Business Transactions

Information may be transferred in connection with an acquisition, merger, financing, restructuring, sale of assets, insolvency or similar transaction, subject to applicable law and appropriate protections.

18 — GOOGLE SERVICES

The Lunar Method® uses Google services for certain business and customer-service activities.

Depending upon the service, Google services may be used to:

  • provide the Important Access & Intake Form and other forms or documents;

  • receive or store information submitted through those resources;

  • send and receive customer communications through Gmail;

  • receive customer-submitted tracking materials;

  • provide applicable Google-hosted resources, including certain MOON® Calendar resources; and

  • support business communications and document management.

Information submitted through Google-hosted resources or Gmail is processed using Google's systems in addition to being processed by The Lunar Method® for the applicable purpose.

Google may process information according to the services it provides, applicable contractual arrangements and its legally applicable privacy practices.

Google operates services and infrastructure internationally. We do not represent that information is necessarily stored or processed only in the customer's country or only in the United States.

Customers are responsible for maintaining appropriate security over their own Google and email accounts.

19 — FACEBOOK, INSTAGRAM, MESSENGER & META SERVICES

The Lunar Method® uses or may use Facebook, Instagram and Facebook Messenger, provided through Meta services, for business, community, communication and marketing activities.

Facebook Messenger is currently used as a designated communication channel for certain customer services, including applicable 1:1 communications, check-ins and customer submission of tracking information.

Where you interact with The Lunar Method® through Facebook, Instagram or Messenger, Meta may independently collect and process information concerning your account, communications, device, activity or use of its services according to its applicable terms and privacy practices.

Where information is sent directly to our business through Messenger, The Lunar Method® processes the content for the purpose for which it was submitted and other compatible lawful purposes described in this Privacy Policy.

Information transmitted through Messenger is also processed through Meta's systems.

Our use of Meta business integrations or advertising technologies does not mean that private information supplied through a 1:1 service communication is automatically authorized for advertising use.

The Lunar Method® does not have access to unrelated private Facebook or Messenger communications merely because a customer communicates with our business through Meta.

20 — SHOPIFY, SHOPIFY NETWORK INTELLIGENCE & ENHANCED SERVICES

Our online store is hosted by Shopify.

When you visit, browse, interact with or make a purchase through our Shopify store, Shopify collects and processes personal information in connection with providing its ecommerce platform and related services.

Depending upon the services and features involved, this may include customer, account, device, browsing, product-interaction, transaction, purchase, checkout and related information.

Shopify Network Intelligence

Our store currently has Shopify Network Intelligence enabled.

When Shopify Network Intelligence is enabled, Shopify may use eligible customer data from interactions and transactions with our store together with information from interactions with other Shopify merchants and Shopify to generate insights and provide Shopify Enhanced Services.

Enhanced Services may be used for purposes including:

  • providing more customized experiences;

  • improving products and personalization;

  • understanding customer interactions with stores and advertising;

  • improving store performance; and

  • providing or improving advertising and marketing services.

Information concerning activity on our store may therefore be shared with and processed by Shopify and applicable third parties, including parties located in countries other than the customer's country, in order to provide Shopify services, including services incorporating information from interactions with other merchants and Shopify.

Other Shopify merchants do not receive direct access to our customer data merely because Network Intelligence is enabled.

Certain uses of Shopify Enhanced Services may constitute “sharing” or “targeted advertising” under privacy laws in certain U.S. states. Where an applicable opt-out right exists, eligible customers may use our Your Privacy Choices page:

https://theoriginallunarmethod.com/pages/data-sharing-opt-out

Our Shopify cookie banner and applicable privacy controls may also be used to obtain or communicate consent choices where required.

Shopify states that where its properly integrated privacy tools are used, applicable customer consent and opt-out choices are communicated to Shopify Network Intelligence for the relevant processing.

Customers may learn more about Shopify's processing and privacy practices through:

Shopify Consumer Privacy Policy:
https://www.shopify.com/legal/privacy/consumers

Customers may also use Shopify's privacy portal to learn about or exercise applicable rights directly concerning certain Shopify processing:

Shopify Privacy Portal:
https://privacy.shopify.com/

Shopify's role may vary according to the particular processing activity. Depending upon the service, Shopify may process information on our behalf and may independently determine purposes and means of certain processing.

Separation From Private Personalized-Service Information

Our Shopify storefront is not intended to serve as the primary submission channel for customers' detailed private cycle-tracking or individualized reproductive-service information.

The Lunar Method® does not intentionally configure Shopify advertising or marketing technologies to collect private LH or BBT tracking submitted for personalized services, intercourse or conception timing, private pregnancy information, test-strip photographs, Personalized Peak Parameters or individualized Sway® analyses for third-party targeted advertising.

However, because The Lunar Method® offers gender-swaying and reproductive-related products and services, ordinary browsing, product-view or purchase information may itself reveal or suggest an interest in those subjects. We therefore apply applicable privacy choices and protections to Shopify information according to its nature, use and applicable law.

21 — SUBSCRIPTION & PAYMENT SERVICES

Where you purchase a recurring subscription, applicable information may be processed through Appstle or another subscription-management provider used by The Lunar Method®.

This may include information necessary to create and maintain subscriptions, administer recurring billing, display subscription information, process cancellations, update preferences, maintain subscription status and provide applicable communications.

Payments may separately be processed through Shopify's payment functionality or other providers available at checkout.

Those providers process information according to their respective roles, contractual arrangements and privacy terms.

22 — SWAY® CIRCLE, OFFICIAL COMMUNITY & OTHER COMMUNITIES

The Lunar Method® operates or administers communities that may include:

  • The Lunar Method® Sway® Circle;

  • The Lunar Method® Official Community | Gender Sway, Reimagined.™; and

  • other official Lunar Method® communities.

Communities may contain posts, comments, questions, experiences, photographs or other information voluntarily submitted by members.

The privacy of a community depends in part upon its access settings and the functionality of the third-party platform hosting it.

Information voluntarily posted in a community may be visible to other people with access to that community.

A private or restricted group should not be treated as equivalent to a confidential 1:1 communication with The Lunar Method®.

Community rules may prohibit unauthorized copying, disclosure or redistribution of member information and Lunar Method® materials, but no online community can guarantee that another participant will never improperly capture, copy or disclose information.

Private information submitted directly to The Lunar Method® for an individualized service through a designated communication or submission channel is treated separately from information a customer voluntarily posts within a community.

23 — CUSTOMER-SUPPLIED FILES, SCREENSHOTS & THIRD-PARTY APP INFORMATION

Customers may submit screenshots, tracking charts, photographs, test-strip images, files, spreadsheets, records or other materials where relevant to a Lunar Method® service.

These materials may contain information generated through third-party applications or devices selected by the customer.

Unless expressly stated otherwise, The Lunar Method® receives only the information the customer chooses to submit.

Sending us a screenshot, exported chart, photograph or reading does not ordinarily provide us with access to the customer's complete account with the originating provider, unrelated information held within that account, the customer's device, or future information generated by the service or device.

Third-party applications and devices remain subject to their own privacy practices.

24 — TESTIMONIALS, SWAY® STORIES & CUSTOMER RESULTS

Customers may provide reviews, testimonials, Sway® Stories, photographs, pregnancy announcements, birth announcements, baby-sex information, gender-swaying results or other experiences.

Information supplied privately in connection with a purchased service is not automatically authorized for public testimonial, advertising or marketing use merely because we possess it.

Where identifiable customer material or sensitive information is used publicly, we rely upon an appropriate lawful basis and obtain consent or permission where required.

A customer's decision to post information publicly on a Lunar Method® Platform does not automatically provide unrestricted permission to repurpose that information for advertising outside its original context.

Anonymous or lawfully de-identified information may be used where it no longer constitutes personal information under applicable law.

25 — CUSTOMER HISTORY, INTERNAL ANALYSIS, METHODOLOGY & OUTCOMES

The Lunar Method® may maintain and analyze appropriate customer information for lawful purposes including:

  • customer history and service continuity;

  • quality assurance;

  • methodology evaluation or development;

  • understanding patterns or customer experiences;

  • product or service improvement;

  • reported outcome analysis;

  • statistical analysis;

  • business analysis;

  • integrity or evidentiary records; and

  • legal or rights-protection purposes.

Where information remains identifiable, applicable privacy requirements continue to apply.

Where sensitive, special-category or consumer health information is involved, additional requirements applicable to that information also continue to apply.

We may create aggregated, anonymized, de-identified or appropriately pseudonymized information where appropriate.

Information that has genuinely been anonymized or de-identified so that it no longer constitutes personal information under applicable law may be used for lawful purposes.

Where applicable law requires separate consent or authorization for secondary methodology, outcome, statistical or similar processing of sensitive information, we obtain the required consent or authorization.

Nothing in this section authorizes publication of identifiable private customer reproductive or cycle-tracking information without an appropriate lawful basis.

26 — ARTIFICIAL INTELLIGENCE, AUTOMATION & TECHNOLOGY

The Lunar Method® may use software, automation, artificial-intelligence-assisted tools or other technologies in appropriate business operations.

Use of technology does not eliminate privacy obligations.

Where customer information is provided to an external technology provider, we consider the nature and sensitivity of the information, purpose of processing, provider's role, applicable contractual protections and applicable legal requirements.

Where practical and appropriate, we minimize direct identifiers submitted with sensitive analytical variables.

Removing direct identifiers does not necessarily mean information has become legally anonymous.

We do not intentionally provide identifiable private customer cycle tracking, reproductive information, conception or pregnancy information, intercourse/BD information or individualized Sway® information to train a publicly available general-purpose AI model for unrelated purposes.

If we introduce automated decision-making or profiling producing legal or similarly significant effects and applicable law requires additional disclosures, rights or safeguards, those requirements will be addressed.

27 — ADULTS ONLY

The Lunar Method® products and services are exclusively intended for individuals aged 18 or older.

We do not knowingly sell or provide our gender-swaying or personalized reproductive-information services to persons under 18, and we do not knowingly solicit sensitive cycle, reproductive or consumer health information directly from persons under 18.

If we learn that information has been collected directly from a person under 18 in circumstances inconsistent with this requirement or applicable law, we will take appropriate action.

An adult customer may provide limited information concerning their existing children where reasonably relevant to family circumstances, a gender-swaying journey, customer story or another lawful purpose.

Information concerning a child supplied by an adult remains subject to applicable privacy requirements.

28 — DATA MINIMIZATION

We seek to collect personal information reasonably appropriate to the purpose for which it is processed.

Some individualized Lunar Method® services necessarily require more information than an ordinary ecommerce transaction because they involve tracking, personalization or analysis.

That does not mean every service requires every category described in this Privacy Policy.

Customers should avoid submitting unrelated sensitive information we have not requested.

29 — SECURITY & INTERNAL ACCESS

The Lunar Method® is a small founder-operated business.

Internal access to private 1:1 customer sensitive information is limited to Samantha Lajoie and Kristi Anderson, except where disclosure to an external provider or professional is reasonably necessary for a legitimate purpose described in this Privacy Policy.

Moderators, ordinary community members and unrelated contractors do not receive access to private personalized-service information merely because of those roles.

Depending upon the system and information involved, safeguards may include:

  • account and access restrictions;

  • authentication measures;

  • device security;

  • platform security controls;

  • service-provider safeguards;

  • limiting unnecessary copies;

  • separating private customer information from public community information;

  • minimizing information submitted to external systems;

  • deleting temporary working copies when no longer reasonably necessary; and

  • other reasonable administrative, organizational and technical safeguards.

No method of electronic transmission or storage can be guaranteed to be completely secure.

Customers are responsible for protecting their own account credentials, email accounts, devices and third-party platform accounts.

30 — DATA INCIDENTS & BREACH NOTIFICATION

Where a privacy or security incident involving personal information occurs, we will assess and respond to the incident and provide notifications to affected individuals, regulators or others where required by applicable law.

Requirements may depend upon the nature and sensitivity of the information, security measures involved, affected individuals, relevant systems and applicable jurisdiction.

Potentially applicable requirements may include U.S. state breach or consumer-health-data requirements, UK or EU GDPR requirements, Canadian requirements, Australian requirements or other applicable privacy or security laws.

The FTC Health Breach Notification Rule applies to defined categories of covered entities and activities. Where The Lunar Method® or a particular activity falls within that Rule or another specialized breach-notification regime, applicable obligations will be addressed as required.

Reference to a legal regime does not mean that regime applies to every Lunar Method® product, service or processing activity.

31 — DATA RETENTION

We retain personal information for no longer than reasonably necessary for the purposes for which it was collected and for legitimate legal, operational and business purposes.

Retention may depend upon:

  • the nature and sensitivity of the information;

  • applicable product or service;

  • customer relationship;

  • fulfillment or personalization requirements;

  • accounting and tax obligations;

  • subscription records;

  • customer-service needs;

  • consent or authorization records;

  • limitation periods;

  • disputes;

  • fraud prevention;

  • intellectual-property protection;

  • legal claims;

  • security;

  • regulatory requirements; and

  • demonstrating compliance.

Different categories may be retained for different periods.

Sensitive reproductive or cycle information is not necessarily retained for the same period as ordinary transaction records.

When information is no longer reasonably required, we may delete, anonymize or otherwise securely dispose of it as appropriate and subject to applicable law.

A deletion request does not require deletion where applicable law permits or requires continued retention.

32 — INTERNATIONAL PROCESSING & DATA TRANSFERS

The Lunar Method® serves customers internationally and uses providers with international operations.

Because The Lunar Method® is operated by a United States company and uses services including Shopify, Google and Meta, personal information may be transferred to, stored in, accessed from or processed in countries other than the customer's country.

Privacy laws in those countries may differ.

Where UK GDPR, EU GDPR or another applicable law restricts international transfers, we use an appropriate lawful transfer mechanism where required.

Depending upon the circumstances, this may include an applicable adequacy mechanism, Standard Contractual Clauses, UK transfer mechanisms or another legally recognized safeguard or exception.

The particular countries and safeguards involved may depend upon the provider, service, configuration and processing activity.

33 — PRIVACY BY SERVICE & COLLECTION NOTICES

This Privacy Policy provides general privacy information.

Certain forms, services, technologies or processing activities may require more specific information at the point of collection.

We may therefore provide additional collection notices, consent language or privacy disclosures concerning:

  • the Important Access & Intake Form;

  • sensitive reproductive information;

  • individualized services;

  • consumer health data;

  • testimonials or Sway® Stories;

  • cookies or advertising technologies;

  • future applications or devices;

  • research or statistical initiatives; or

  • another activity requiring more specific notice.

A more specific privacy notice supplements this Privacy Policy for the processing it addresses.

Where explicit or separate consent is legally required, general acceptance of this Privacy Policy or contractual terms does not substitute for that consent.

34 — YOUR PRIVACY RIGHTS & CHOICES

Depending upon your location and applicable law, you may have rights to:

  • request access;

  • obtain information concerning processing;

  • request correction;

  • request deletion;

  • obtain portability;

  • object to certain processing;

  • request restriction;

  • withdraw consent where processing is based upon consent;

  • opt out of certain sales, sharing or targeted advertising;

  • limit certain processing of sensitive information;

  • opt out of certain profiling;

  • appeal certain privacy decisions where applicable; and

  • complain to an applicable privacy or data-protection authority.

Applicable sale, sharing or targeted-advertising choices may be available through:

Your Privacy Choices:
https://theoriginallunarmethod.com/pages/data-sharing-opt-out

Where applicable law requires recognition of a valid opt-out preference signal, including GPC, we process the signal as required.

Privacy rights are not absolute and may be subject to legal exceptions.

We may take reasonable steps to verify identity before fulfilling a request.

We will not unlawfully discriminate against an individual for exercising an applicable privacy right.

35 — U.S. PRIVACY & CONSUMER HEALTH DATA RIGHTS

Residents of certain U.S. states may have additional rights under comprehensive privacy, sensitive-data or consumer-health-data laws.

Depending upon jurisdiction, statutory scope and the processing involved, these may include rights concerning:

  • access or confirmation;

  • correction;

  • deletion;

  • portability;

  • categories of information processed;

  • sale;

  • sharing;

  • targeted advertising;

  • profiling;

  • sensitive data;

  • consumer health data;

  • withdrawal of consent;

  • authorized-agent requests; and

  • appeals.

Where applicable law requires consent before collecting, using or disclosing particular sensitive or consumer health data, we obtain the required consent or other legally permitted authorization.

Where separate authorization is required for a sale or other regulated disclosure of consumer health data, acceptance of this Privacy Policy does not substitute for that authorization.

Additional disclosures and rights concerning consumer health data are provided in our Sensitive & Consumer Health Data Privacy Policy.

Nothing in this Privacy Policy limits a right that applicable law does not permit us to limit.

36 — UK & EEA PRIVACY RIGHTS

Where UK GDPR or EU GDPR applies, individuals may have rights including:

  • access;

  • rectification;

  • erasure;

  • restriction;

  • portability;

  • objection;

  • withdrawal of consent; and

  • applicable rights concerning certain automated decision-making.

Where processing is based upon consent, withdrawal does not affect processing lawfully undertaken before withdrawal.

Where processing is based upon legitimate interests, an individual may have a right to object in circumstances provided by law.

Individuals may also lodge a complaint with the competent supervisory authority.

UK individuals may have the right to complain to the UK Information Commissioner's Office where it is the competent authority. EEA individuals may have the right to complain to their applicable supervisory authority.

Customers in the UK, EEA or Switzerland may also use Shopify's privacy portal for applicable rights concerning certain processing undertaken directly by Shopify:

https://privacy.shopify.com/

Where appointment of a UK or EEA representative is legally required, applicable contact information will be made available as required.

37 — AUSTRALIAN PRIVACY

Where the Australian Privacy Act 1988 and Australian Privacy Principles apply to a particular processing activity, personal information will be handled subject to applicable requirements.

Sensitive information receives additional protection where applicable.

Australian individuals may have applicable rights concerning access, correction and complaints.

Where applicable law requires information concerning likely overseas disclosures or recipient countries, we will provide that information as required.

Nothing in this Privacy Policy limits rights available under applicable Australian privacy law.

38 — CANADIAN PRIVACY

Where Canadian federal, provincial or territorial privacy law applies, applicable rights and requirements remain unaffected.

Depending upon the applicable law, individuals may have rights concerning access, correction, consent, withdrawal of consent, transparency, complaints and other matters provided by applicable privacy legislation.

The form of consent appropriate to an activity may depend upon the sensitivity of the information and circumstances.

Where sensitive reproductive or cycle information is involved, we account for that sensitivity in determining applicable privacy requirements.

39 — PRIVACY REQUESTS

Applicable choices concerning activities that may be considered sale, sharing or targeted advertising may be exercised through:

https://theoriginallunarmethod.com/pages/data-sharing-opt-out

Other applicable privacy requests concerning information controlled by The Lunar Method® may be submitted to:

info@theoriginallunarmethod.com

Please provide sufficient information for us to understand the request and identify relevant records.

We may request reasonable information to verify identity before disclosing, correcting or deleting personal information.

Where an authorized representative submits a request, we may request appropriate evidence of authority where permitted.

Where a request concerns information for which a third party independently acts as controller or equivalent responsible entity, you may also need to exercise applicable rights directly with that provider.

40 — PRIVACY COMPLAINTS

Privacy concerns or complaints may be submitted to:

info@theoriginallunarmethod.com

Please provide enough information for us to understand and investigate the concern.

We will review privacy complaints and respond in accordance with applicable law.

Nothing in this section requires an individual to complain to us before approaching a regulator or supervisory authority where applicable law permits direct contact with that authority.

41 — COMMUNICATION PREFERENCES

You may unsubscribe from promotional email through the unsubscribe mechanism provided in the communication.

Unsubscribing from marketing does not prevent necessary non-promotional communications, including:

  • order confirmations;

  • subscription communications;

  • cancellation confirmations;

  • fulfillment communications;

  • service communications;

  • security notices;

  • privacy or legal notices; and

  • responses to communications you initiate.

Applicable rights concerning electronic marketing communications remain unaffected.

42 — THIRD-PARTY WEBSITES, APPS & SERVICES

Our website, products, services and Lunar Method® Platforms may interact with, rely upon or link to websites, applications, platforms or services operated by third parties.

We do not control a third party's independent privacy or security practices merely because we link to, integrate with or use its services.

Customers should review applicable third-party privacy information before providing information directly to that provider.

Reference to or use of a third-party service does not by itself establish endorsement, partnership, joint controllership or control.

The legal relationship between The Lunar Method® and a third party depends upon the actual processing activity and applicable law.

43 — CHANGES TO THIS PRIVACY POLICY

We may revise this Privacy Policy to reflect changes in:

  • products or services;

  • information-processing activities;

  • technology;

  • service providers;

  • legal requirements;

  • privacy practices; or

  • business operations.

When revised, the Last Updated date will be changed.

Where applicable law requires additional notice, consent or another procedure for a change, we will follow that requirement.

An updated Privacy Policy does not retroactively authorize processing that was unlawful when undertaken.

Materially different use of previously collected sensitive information will not be justified merely by publishing revised wording where applicable law requires additional notice, consent or another legal basis.

44 — RELATIONSHIP WITH OTHER LEGAL DOCUMENTS & PRIVACY CONTROLS

This Privacy Policy should be read together with applicable Lunar Method® legal documents and privacy controls, including:

  • Sensitive & Consumer Health Data Privacy Policy;

  • Terms of Service;

  • Disclaimer;

  • Legal Notice;

  • Brand Integrity;

  • Refund, Cancellation, Subscription & Store Credit Policy;

  • Shipping Policy, where applicable;

  • Your Privacy Choices;

  • applicable cookie or consent notices;

  • applicable product or service descriptions;

  • purchase terms;

  • community rules; and

  • other applicable notices or conditions.

Your Privacy Choices:
https://theoriginallunarmethod.com/pages/data-sharing-opt-out

Your Privacy Choices is an operational privacy-rights mechanism provided through our Shopify store and is not, merely by being referenced here, converted into a contractual agreement between a customer and The Lunar Method®.

This Privacy Policy principally governs collection, use, processing, disclosure, retention and protection of personal information.

Our Sensitive & Consumer Health Data Privacy Policy provides additional and more specific information concerning sensitive reproductive information and consumer health data.

Where a more specific privacy notice applies to particular processing, that notice supplements this Privacy Policy and governs that privacy matter to the extent of any applicable inconsistency, subject to mandatory law.
